Terms and Conditions

Introduction
These general terms and conditions (hereinafter referred to as „T&C“) are issued by MgA. Anna Dušáková, located at Kounice 345, ZIP code 289 15, ID: 00798851, registered in the Trade Register (hereinafter referred to as „the photographer“), in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, as amended, and govern the mutual rights and obligations arising from the agreement for photographic services (hereinafter referred to as the „Agreement“) or related to it, concluded between the photographer and the client (hereinafter referred to as the „client“).

The provisions of these T&C are an integral part of the Agreement concluded between the photographer and the client, and the client is notified of and has the opportunity to review them before concluding the Agreement. By signing the Agreement, the client agrees that these T&C become an integral part of the Agreement.

All contractual relationships between the photographer and the client are governed by the legal order of the Czech Republic.

These T&C are effective as of January 1, 2025.

Subject and Order of Photographic Services
The subject of the photographic services is the creation of photographs by the photographer for the client based on their order, in the form of a package of edited photographs in electronic format.

Orders can be made electronically via the contact form or the Calendly reservation system. By confirming the order, the client agrees that these T&C become an integral part of the Agreement.

The photoshoot date depends on the photographer’s availability, the number of requested photographs, and, in the case of an outdoor photoshoot, the weather, which may result in rescheduling the session.

Price of Photographic Services
The price for the photography services is set at 400 EUR.

The price for the chosen photography package must be paid in full via bank transfer based on the issued invoice. The work will be delivered to the client only after full payment.

Execution of Photoshoot
The photoshoot will take place on a pre-arranged date, which must be strictly adhered to. Early arrival is not desirable, and a delay of more than 30 minutes without prior notice will result in the cancellation of the booking.

Timely cooperation with the photographer and following instructions is necessary to ensure a smooth photoshoot and optimal results.

Inappropriate behavior or offensive conduct by the client may result in the cessation of work, and the unfinished work will be handed over without a reduction in the agreed price.

Agreed photoshoot dates must be postponed or canceled at least one day before the scheduled date. In case of bad weather, the outdoor photoshoot will be rescheduled.

The photographer is entitled to cancel or postpone the photoshoot due to serious reasons (illness, injury, etc.). The client will be informed in a timely manner via phone, email, social media message, or SMS.

For locations with an entrance fee (such as gardens, castle parks, etc.), the entrance fee or other charges for the photographer are not included in the price. These fees are paid by the client.

Without the photographer’s prior consent, it is prohibited to make any visual or audiovisual recordings during the photoshoot.

Selection, Processing, and Delivery of Photos
The photographer will primarily select the photographs for final editing, or, if agreed upon by both parties, the client can choose the photos from an online gallery with previews and watermarks.

All selected photographs are edited according to the photographer’s style. Dissatisfaction with the photographic style or artistic approach is not grounds for a complaint.

The photographer does not guarantee the number of edited photos if the client’s limitations (such as time constraints or reluctance to pose) significantly reduce the possibilities of the photoshoot. In such cases, the client is not entitled to a reduction in price.

Unedited photographs are not provided to the client.

If requested by the client, minor adjustments to proportions can be made. For more extensive retouching (such as slimming, tattoo removal, teeth adjustments, hair retouching, etc.), an additional fee will be charged based on the complexity.

Printing of photos is possible for an additional fee, which will be individually agreed upon.

The delivery time for photos is 1–6 weeks after the full payment has been made.

The finished photos are delivered via online storage, from where the client can download them.

The photographer will archive the selected and edited photos for 3 months from the date of delivery.

Copyright
All photographs taken by the photographer are subject to the Copyright Act No. 121/2000 Coll. The client may not use the photographs for commercial purposes, promotion, or resale to third parties without the photographer’s prior written consent. Only brand-specific photos taken for promotional purposes may be used for such purposes.

Consent to Use of Photos
The photographer reserves the right to use photos from the photoshoot in her portfolio, for promoting her services, in offers, for advertising and commercial purposes, on social media, and on her website. If the client does not consent to the use of the photos, they must inform the photographer no later than the day before the photos are delivered.
